Judgment text excerpt
The Supreme Court held that the appointment of a 'fourth peon' in an aided educational institution is not supported by the Orissa Education Act, 1969 or the Recruitment Rules, which do not prescribe such a position. The Court emphasized that the post of 'Daftary' is a promotional post and cannot be equated with that of a 'fourth peon'. The High Court's decision to equate the two was overturned, and the appeal by the State of Orissa was allowed, reaffirming the validity of the yardstick prescribed in the circulars issued by the State.
