The Supreme Court ruled that employees of non-statutory recognized canteens are entitled to the same benefits as Railway employees, as established in M.M.R.Khan & Others vs. Union of India. The Court held that the relationship of employer and employee exists between the Railway Administration and canteen employees, and thus, service conditions applicable to Railway employees should be extended to them. The decision affirmed the applicability of benefits from 1.10.1991, with pension calculations including service from the date of the interim order.
