Judgment text excerpt
The Supreme Court ruled that teachers who superannuate during an academic year but continue in service under Rule 62 of Chapter XIV(A) of the Kerala Education Rules, 1959, are entitled to the benefits of pay revision effective from 1.3.1997 as per G.O. No. 3000/98/Fin. The Court held that the provisions of Rule 60(C) of the Kerala Service Rules, which stipulate that increments or promotions are not granted post-superannuation, do not exclude the applicability of pay revisions. The appeals by the State were dismissed, affirming the Full Bench's decision that the revised pay scale should be applied to the concerned teachers.
