Judgment text excerpt

The Supreme Court upheld the constitutional validity of the Bombay City Civil Court and Bombay Court of Small Causes (Enhancement of Pecuniary Jurisdiction & Amendment) Act, 1986 (Maharashtra Act No. XV of 1987) and the Maharashtra High Court (Hearing of Writ Petitions by Division Bench and Abolition of Letters Patent Appeals) Act, 1986 (Maharashtra Act XVII of 1986). The Court found that the High Court's decision to defer the implementation of the notification dated 20th August 1991 was justified, as the necessary infrastructure for the City Civil Court was not in place. The appeal was allowed, affirming the High Court's ruling and maintaining the validity of the Acts in question under Articles 14 and 19(1)(g) of the Constitution of India.
