Judgment text excerpt

The Supreme Court partly allowed the appeals against the Allahabad High Court's judgment quashing the land acquisition notifications under Section 4 and Section 6 of the Land Acquisition Act, 1894. The Court noted that the State of Uttar Pradesh had initiated de-notification of a portion of the land under Section 48(1) of the Act, which was in possession of the respondent, thereby releasing it from acquisition. The Court held that the acquisition for the benefit of a private school was not valid, but allowed the de-notification process to proceed.
