The Supreme Court upheld the Allahabad High Court's decision that the termination of the respondent's services was contrary to Section 6(N) of the Uttar Pradesh Industrial Disputes Act, 1947. The Court clarified that the definition of 'continuous service' under Section 2(g) of the U.P. Act was applicable, and the respondent had indeed completed the requisite 240 days of service. Consequently, the Court directed the reinstatement of the respondent with continuity of service and 50% back wages from the date of termination until the date of the award.
