The Supreme Court held that under Section 2(n) of the Workmen’s Compensation Act, 1923, a 'workman' does not include casual workers not employed for the employer's trade or business. The Court found that the Labour Court and the Patna High Court erred in entertaining the claim of Ramu Pasi, who was categorized as a casual worker. However, due to the minimal compensation awarded, the Court directed that any amount already paid should not be recovered, and if not paid, it should be disbursed.
