The Supreme Court held that under Section 2(n) of the Workmen's Compensation Act, 1923, a 'workman' does not include casual workers not employed for the employer's trade or business. The Court found that the Labour Court and the High Court erred in accepting the claim of Ramu Pasi, a casual worker, for compensation. However, due to the small quantum awarded, the Court directed that any amount already paid shall not be recovered, and if not paid, it should be disbursed to the claimant immediately.
