Judgment text excerpt

The Supreme Court examined the applicability of Sections 144 and 145 of the Code of Civil Procedure (C.P.C.) in the context of a decree against the State of Rajasthan. The Court upheld the District Judge's decision allowing the State's application for recovery against Smt. Kamla Devi and clarified that the attachment of House No. 80B Block Sri Ganganagar was improper as it belonged to Smt. Dhanwanti Devi, who had bequeathed it to Ashutosh. The Court ruled that Ashutosh, as the legatee, was entitled to the property, and the attachment order was set aside.
