Judgment text excerpt

The Supreme Court, in a reference under Article 317(1) of the Constitution, addressed the preliminary objection regarding the maintainability of the Reference concerning alleged misbehaviour of Dr. H.B. Mirdha, Chairman of the Orissa Public Service Commission. The Court sought clarification on whether the advice of the Council of Ministers under Article 74 was necessary before the President made the Reference. The Court framed issues regarding the applicability of Article 74 to the Reference process and scheduled a hearing for further arguments after obtaining essential factual information from the Union of India.
