Judgment text excerpt

The Supreme Court addressed the implications of Haryana Amending Act No.10 of 1995 on the right of co-sharers to pre-empt sales. The Court held that the Amending Act was prospective and did not affect decrees passed before its enactment, thus upholding the first appellate court's decree in favor of the plaintiff-appellant Ram Kanwar. The Court corrected an error in the operative part of its earlier judgment dated 31.7.2001, which had mistakenly stated the appeal was dismissed instead of allowed.
