The Supreme Court upheld the decision of the Customs, Excise and Gold (Control) Appellate Tribunal (CEGAT) regarding the appeals filed by M/s Pearl Engineering Polymers Ltd. and its directors against the Commissioner of Customs. The Court found that the company had complied with the conditions of the Export Promotional Capital Goods (EPCG) Scheme and did not divert goods in violation of the import conditions under Para 14 of the Export and Import Policy, 1992-97. The Court affirmed CEGAT's order setting aside the Commissioner’s original order, thereby ruling in favor of the respondents.
