Judgment text excerpt

The Supreme Court held that under Section 26(6) of the Indian Electricity Act, 1910, a consumer must raise a dispute regarding the accuracy of an electricity meter before the Electrical Inspector. The Court found that the first respondent, Laffans (India) Pvt. Ltd., failed to do so, thus upholding the appellant's right to replace the defective meter and issue revised bills based on average consumption. The Court reversed the Bombay High Court's decision that quashed the demand notice and allowed the appeal, reinstating the demand for payment.
