The Supreme Court held that the proceedings before the Industrial Court under The Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 were maintainable, and the Division Bench of the Bombay High Court was justified in directing the employer to furnish a bank guarantee for 50% of the wages due to the retrenched employees. The Court emphasized that the Industrial Court had jurisdiction to adjudicate the matter, and the employer's claims regarding jurisdiction were dismissed. The appeal was therefore rejected, upholding the High Court's order.
