The Supreme Court examined the entitlement of appellants to the benefit of allotment of Beshi Phirni area under the amended Scheme of consolidation as per Section 42 of the East Punjab Holding (Consolidation & Prevention of Fragmentation) Act, 1948. The Court held that the benefit of Beshi Phirni should be granted to original bhumidars, and since the respondent No. 3 purchased the land after the original Scheme, he was not entitled to such benefit. The appeal was dismissed, affirming the lower court's decision.
