The Supreme Court ruled that under Section 36 of the East Punjab Holding (Consolidation & Prevention of Fragmentation) Act, 1948, the appellants, as original bhumidars, are entitled to the benefit of allotment of Beshi Phirni due to the inclusion of Killa No. 28/22 in the extended phirni. The Court held that the Financial Commissioner erred in granting the benefit to the subsequent purchaser, respondent No. 3, who was not an original bhumidar. Consequently, the Court allowed the appeal and set aside the orders of the Financial Commissioner and the High Court dismissing the appellants' claims.
