Judgment text excerpt

The Supreme Court upheld the validity of the Will dated 08.05.1983 executed by Prati in favor of his daughter, Respondent No. 1, while revoking the earlier Will dated 11.01.1977. The Court found that the first Appellate Court correctly determined that Respondent No. 1 was indeed Prati's daughter and that the second Will was executed in sound mind and in the presence of witnesses. The appeal by the appellants was dismissed, affirming the lower court's decree in favor of Respondent No. 1 under the principles of testamentary succession as outlined in the Indian Succession Act, 1925.
