State Of Kerala vs Nazar

The Supreme Court dismissed Criminal Appeals Nos. 1043 and 1044 of 1999, affirming the High Court's decision which acquitted several accused under Section 302 IPC and Section 149 IPC due to lack of evidence for an unlawful assembly. The Court held that the accused acted independently and not in furtherance of a common unlawful object, thus Section 149 IPC was inapplicable. The appeal of YesuDas @ Tommy abated following his suicide, while the appeal by the State of Kerala against A2 Nazar was dismissed as well.
