The Supreme Court held that the provisions of Section 51A of the Pepsu Tenancy and Agricultural Lands Act, 1955, which exempts land granted for gallantry before January 26, 1950, from being counted as surplus, were applicable in this case. The Court found that the appellants were not given an opportunity to be heard in the earlier proceedings, thus violating principles of natural justice. The Court set aside the High Court's order and restored the Single Judge's decision, allowing the appellants to retain possession of the land.
