Judgment text excerpt
The Supreme Court examined the legal status of the 'State advised cane price' under the U.P. Sugarcane (Regulation and Purchase) Act, 1953, concluding that there is no statutory basis for such a price, which is merely advisory and lacks binding authority. The Court held that the State Government's fixation of sugarcane prices does not constitute a statutory requirement and cannot be enforced as law. Consequently, the Court ruled that the 'State advised cane price' does not have the force of law and sugar factories are not legally obligated to comply with it.
