Judgment text excerpt

The Supreme Court examined the constitutionality of the West Bengal College Service Commission Act, 1978, which mandates the appointment of teachers through a state-appointed commission. The Court held that while religious denominations have the right to establish educational institutions under Articles 19(1)(g) and 26(a) of the Constitution, this right is subject to reasonable restrictions in the interest of the public. The Court concluded that the procedure established by the College Service Commission for appointing teachers is permissible and does not infringe upon the rights of the petitioners, thus dismissing their challenge.
