The Supreme Court held that an agreement regarding the age of superannuation made under Section 79(c) of the Electricity (Supply) Act, 1948, prevails over subsequent regulations, affirming that the age of retirement for employees of the Madhya Pradesh State Electricity Board was set at 60 years as per an agreement made in 1996. The Court ruled that the notification reducing the age of superannuation to 58 years was invalid as it contravened the earlier agreement and the provisions of the Madhya Pradesh Industrial Relations Act, 1960. The Court upheld the High Court's decision to quash the impugned notification, thereby maintaining the age of retirement at 60 years.
