The Supreme Court addressed the validity of the appointment of the Managing Director as the authority under Section 32G of the State Financial Corporations Act, 1951, which allows for the recovery of amounts due to Financial Corporations. The Court held that the Managing Director cannot be appointed as such authority due to the principle of 'no man can be a judge in his own cause', thereby upholding the Delhi High Court's decision to strike down the appointment and the Certificates of Recovery. The Court also clarified that while the Delhi High Court's ruling was upheld, it did not invalidate the constitutionality of Section 32G itself.
