The Supreme Court held that the absence of a notice under Section 10 of the Carriers Act, 1865 does not bar a complaint under the Consumer Protection Act, 1986, as the term 'suit' in both Sections 9 and 10 of the Carriers Act includes proceedings under the Consumer Protection Act. The Court distinguished the earlier decision in B.L. Sharma, asserting that the principles applied to Section 9 also extend to Section 10, thereby allowing consumers to seek redress without unnecessary procedural impediments. The appeal was admitted, and the National Commission's ruling was set aside.
