The Supreme Court held that an agreement regarding the age of superannuation, made under the Madhya Pradesh Industrial Relations Act, 1960, prevails over the regulations framed under Section 79(c) of the Electricity (Supply) Act, 1948. The Court established that the age of retirement can be modified by mutual agreement, and the notification reducing the age of superannuation from 60 to 58 years was invalid as it contravened the earlier agreement. The Court upheld the agreement's validity, thereby allowing the appeal and reinstating the age of superannuation at 60 years.
