Judgment text excerpt

The Supreme Court addressed the legislative competence of the Gujarat State legislature to enact the Gujarat Gas (Regulation of Transmission, Supply and Distribution) Act, 2001 under Entry 25 of List II of the Seventh Schedule of the Constitution. The Court held that the State's power to legislate on gas does not extend to natural gas, which falls under Entry 53 of List I, thus affirming the Parliament's exclusive jurisdiction over petroleum and petroleum products. Consequently, the Gujarat Act was deemed unconstitutional as it conflicted with central legislation.
