Judgment text excerpt

The Supreme Court held that the revocation of leave under clause 12 of the Letters Patent 1865 was justified as no part of the cause of action arose within the original jurisdiction of the Calcutta High Court. The Court emphasized that the jurisdictional requirement necessitates that the cause of action must arise wholly or partly within the specified local limits. Consequently, the suit was directed to be taken off the file and returned to the appellants for presentation to the appropriate court with jurisdiction.
