The Supreme Court held that the appellant is entitled to pro-rata pension under Rule 37 of the Central Civil Services (Pension) Rules, 1972 from the date of his permanent absorption in the Punjab National Bank on 09.02.1984. The Court clarified that the fixation of pension for an employee absorbed in a government-controlled service is governed by Rule 37, and Rule 48's requirement of thirty years of service for voluntary retirement does not apply in this case. The Court overturned the High Court's decision, granting the appellant's claim for pension from the specified date.
