The Supreme Court upheld the High Court's decision to set aside the election of Ram Phal Kundu under Section 116A of the Representation of the People Act, 1951, due to the wrongful rejection of Kamal Sharma's nomination paper. The Court established that the Returning Officer's decision was erroneous as Kamal Sharma was duly nominated by the Congress Party, and thus, the election was declared void. Consequently, the Election Commission was directed to conduct fresh elections for the 50-Safidon Assembly Constituency.
