The Supreme Court upheld the decision of the High Court which rejected the appellant's application to make the arbitration award a Rule of the Court, as the award had been set aside by the Appellate Authority under the Indian Arbitration Act, 1940. The Court ruled that the appellant could not challenge the Appellate Authority's order collaterally in the High Court and must seek remedy through appropriate channels. The Court directed the Arbitrator to issue a fresh award within six months, dismissing the appeal without costs.
