Judgment text excerpt

The Supreme Court, while adjudicating a petition under Article 32, held that pensioners of the Assam Oil Company Limited, who retired before October 13, 1981, are entitled to the revised pension scheme applicable to Indian Oil Corporation retirees. The Court interpreted Sections 5, 6, and 11 of the Burmah Oil Company (Acquisition of Shares of Oil India Ltd. and of the undertakings in India of Assam Oil Company Limited and the Burmah Oil Co. (India Trading Ltd.) Act, 1981), affirming that the rights to pension and other benefits continue post-nationalization. The Court ruled in favor of the petitioners, ensuring their entitlement to the revised benefits without discrimination based on retirement dates.
