Judgment text excerpt

The Supreme Court upheld the decision of the Andhra Pradesh High Court which set aside the detention order under the Andhra Pradesh Prevention of Dangerous Activities of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986. The Court found that two of the five grounds for detention were stale and could not be separated from the remaining grounds, thus vitiating the satisfaction of the detaining authority. The Court emphasized that the detention must be based on current and relevant grounds to justify preventive detention under the Act.
