Judgment text excerpt

The Supreme Court addressed the quashing of proceedings under Section 482 of the Code of Criminal Procedure, 1973, by the Andhra Pradesh High Court, which was based on the incorrect interpretation of the maximum punishment under Section 7(1)(a)(ii) of the Essential Commodities Act, 1955. The Court clarified that the maximum punishment for the offence is indeed seven years, not one year as previously held by the High Court. Consequently, the Court set aside the High Court's order, reinstating the proceedings against the respondents.
