The Supreme Court held that the High Court's refusal to evict the tenant and sub-tenants based on the death of the original tenant was unjustified, overruling the precedent set in A.S. Sulochana Vs. C. Dharmalingam (1987) 1 SCC 180. The Court affirmed that the sub-tenancy created without the landlord's consent warranted eviction under Section 21(1)(f) of the Karnataka Rent Control Act, 1961. The Court restored the District Judge's order for eviction, allowing the landlord's appeal and setting aside the High Court's judgment.
