The Supreme Court addressed the validity of Certificates of Service (CoS) issued under Section 80 of the Merchant Shipping Act, 1958, in light of the STCW 1978 Convention and its 1995 amendments. The Court held that the CoS, granted without examination, could not be treated as valid under the amended Convention, as compliance with the updated training and certification standards was mandatory. Consequently, the Court dismissed the petitions challenging the constitutionality of the Notices and Rules issued for transitioning to Certificates of Competency (CoC).
