Judgment text excerpt

The Supreme Court addressed the validity of Certificates of Service (CoS) issued under Section 80 of the Merchant Shipping Act, 1958, in light of the STCW 1995 Convention. The Court held that the CoS, granted without examination, does not meet the standards set by the Convention, which requires proper training and certification. Consequently, the Court ruled that the impugned Notices and Rules mandating further qualifications for CoS holders are constitutional and valid, thereby dismissing the writ petitions filed under Article 32 of the Constitution.
