The Supreme Court held that under Section 17(3) of the Delhi School Education Act, 1973, the Director of Education has the authority to regulate the fees charged by unaided schools. The Court found that the direction issued on December 15, 1999, regarding the transfer of funds from the Recognised Un-aided Schools Fund does not conflict with Rule 177 of the Delhi School Education Rules, 1973. Furthermore, the managements of recognized unaided schools are entitled to establish a Development Fund Account under the provisions of the Act, affirming the regulatory framework for fee structures in private education.
