The Supreme Court ruled that the non-publication of a final electoral roll does not automatically invalidate an election under Section 116A of the Representation of the People Act, 1951. The Court held that the electoral roll published at 8 p.m. on 23.4.2001 was valid despite allegations of improper deletions and additions of voters' names, as the election results were not materially affected. The appeal against the High Court's dismissal of the election petition was therefore dismissed, affirming the election of the first respondent.
