The Supreme Court held that under Section 6N read with Section 2(g) of the Uttar Pradesh Industrial Disputes Act, 1947, it is not mandatory for workmen to complete 240 days of service in the year preceding termination to claim continuous service benefits. The Court upheld the High Court's ruling that the workmen, having completed 240 days in prior years, were deemed to be in continuous service, thus rendering their termination illegal. The Court affirmed the High Court's directive for reinstatement and payment of wages from the date of reinstatement, excluding back wages.
