The Supreme Court held that the conviction of the appellant under Section 302 IPC was not justified as the evidence did not sufficiently distinguish his actions from those of another accused, A-2, who was convicted under Section 304, Part I IPC. The Court emphasized that both the appellant and A-2 contributed to the cause of death, and thus the appellant's culpability should not exceed that of A-2. Consequently, the Court set aside the conviction under Section 302 IPC and modified the sentence accordingly.
