Judgment text excerpt
The Supreme Court upheld the decision of the Allahabad High Court, which quashed the termination of services of workmen at Kisan Sahkari Chini Mills Ltd. under Section 6N of the Uttar Pradesh Industrial Disputes Act, 1947. The Court established that the Mill, despite being a co-operative society, was subject to writ jurisdiction as it was an instrumentality of the State. The Court held that the workmen, having worked for more than 240 days, were entitled to retrenchment compensation, and directed the Mill to regularize their services within two years.
