The Supreme Court upheld the conviction of the appellants under Section 5(2) read with Section 5(1)(d) of the Prevention of Corruption Act, 1947 for illegally selling electricity to M/s. Graphite India Ltd. without government sanction, resulting in a pecuniary advantage of Rs. 19 lakhs to the company. The Court found that the appellants abused their official positions as public servants, despite no evidence of personal gain. The sentences of one year imprisonment and a fine of Rs. 10,000 each were maintained.
