The Supreme Court examined the legislative competence of the State of Andhra Pradesh to enact the Andhra Pradesh State Council of Higher Education Act, 1988, in light of the University Grants Commission Act under Entry 66, List I of the Seventh Schedule of the Constitution of India. The Court held that the State Legislature lacked the authority to enact the 1988 Act, reaffirming its earlier decision in Osmania University Teachers’ Association Vs. State of Andhra Pradesh [(1987) 4 SCC 671]. Consequently, the Court declared the 1988 Act unconstitutional, thereby upholding the supremacy of the central legislation in matters of higher education coordination.
