The Supreme Court held that under Section 5 of the Orissa Estates Abolition Act, all non-agricultural land vests in the State, and thus the land in question, being Anabadi land, could not have been settled under Section 7 of the Act. The Court found that the High Court erred in allowing the writ petition and set aside the Board of Revenue's order revoking the settlement. Consequently, the appeal by the State of Orissa was allowed, reaffirming the vesting of the land in the State and the invalidity of the settlement made in favor of the sons of Manindra Chandra Sinha.
