Judgment text excerpt

The Supreme Court upheld the Bombay High Court's ruling that the retirement age of Air India air hostesses at 50 years, with an option for ground duties until 58, violated Articles 14, 15, and 16 of the Constitution and Section 5 of the Equal Remuneration Act, 1976. The Court affirmed that the discriminatory policy against female air hostesses compared to their male counterparts was unconstitutional. Consequently, Air India was directed to allow air hostesses to perform flying duties until 58, pay differential salaries, and amend relevant standing orders.
