Judgment text excerpt

The Supreme Court examined the constitutionality of Sections 175(1)(q) and 177(1) of the Haryana Panchayati Raj Act, 1994, which disqualify individuals with more than two children from holding certain elected positions. The Court held that these provisions violate Article 14 of the Constitution, as they impose unreasonable restrictions on the right to contest elections and do not serve a legitimate state interest. Consequently, the Court declared these provisions unconstitutional and struck them down, allowing the affected individuals to continue in their positions.
