The Supreme Court held that under Section 147(1)(b) of the Motor Vehicles Act, 1988, an insurance policy must cover liability for death or injury to passengers of a public service vehicle, including a khalasi, if explicitly included in the policy. The Court found that the insurance certificate indicated coverage for a cleaner, which encompasses the khalasi role, and thus the insurance company was liable for compensation under the Workmen's Compensation Act, 1923. The High Court's ruling was overturned, affirming the liability of the insurance company to pay compensation to the deceased employee's legal heirs.
