Judgment text excerpt

The Supreme Court held that a mere trespasser cannot be considered an encumbrancer under the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948, specifically Sections 19 and 20, as the term 'encumbrancer' refers to legal encumbrances such as leases or mortgages. The Court dismissed the appellant's claim for possession of land due to lack of merit in his argument and also on the grounds of long delay and laches, noting that the appellant's application was made nearly 11 years after the consolidation proceedings concluded in 1982. Consequently, the appeal was rejected.
