The Supreme Court held that under Section 4 of the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978, any alienation of land made in contravention of the terms of grant is null and void. The Court found that the land granted to Gungaiah was not sold at full market value, thus the prohibition against alienation under Rule 43-G of the Mysore Land Revenue Code applied. The Court upheld the orders for resumption of the land, affirming the decisions of the Assistant Commissioner and the High Court of Karnataka.
