The Supreme Court held that under Section 103-A of the Motor Vehicles Act, 1939, the liability of the insurer to pay compensation to a third party does not cease even if the insured vehicle is transferred without notifying the insurer. The Court reaffirmed the principle established in G. Govindan v. New India Assurance Co. Ltd., [1999] 3 SCC 754, stating that the third party's right to recover is not affected by the lack of intimation regarding the transfer. Consequently, the appeal was dismissed, upholding the Tribunal's decision that the appellants were liable to pay compensation.
